Sgt. Kevin Benderman served a combat tour in Iraq and returned home to file a conscientious objector application as his legal refusal to participate further in an unjust, immoral action. He was court-martialed for his actions and served over a year in prison. Kevin and his wife Monica are now working on projects to integrate veterans and communities, and will be speaking about their experiences on a Truth Be Told tour beginning this summer.

When the time comes upon innocent people to kill or be killed there will be a need for something. Where can that something be found?

I suggest, strongly, that volunteering to open your mind now may avoid having your mind opened by force - later. No one lives long in falsehood. Your orders will be to kill or be killed. If you can’t, then, start digging your own grave. If, instead, you choose to fight, then, the first step is awareness - an open mind. It is not too late.

Soldier in Iraq Refuses Combat Mission

 

Please rally whoever you can, call whoever you can, bring as much attention to this as you can. I have no doubt that the military will bury me and hide the whole situation if they can. I'm in big trouble. I'm in the middle of Iraq, surrounded by people who are not on my side. Please help me. Please contact whoever you can, and tell them who I am, so I don't ‘disappear.’”

Eli is taking an incredible risk by refusing orders in Iraq and will most likely be court martialed. Please help him by contacting his Senator and requesting that he take any steps necessary to support and protect this soldier and ensure that the Army respects his rights and does not illegally retaliate against him.

On May 18, Lieutenant Commander Matthew Diaz was sentenced to six months in a Navel brig and removal from the Navy for courageously upholding the constitution of the United States. Apparently this is a very serious crime in America today. Lt. Cmdr. Diaz is actually counting himself lucky, as the 41-year-old officer with 19-years of service to the U.S. Navy faced a possible 14 years in prison.

Sgt. Omar Mora and Sgt. Yance T. Gray died Monday in a vehicle accident in western Baghdad, two of seven U.S. troops killed in the incident which was reported just as Gen. David Petraeus was about to report to Congress on progress in the "surge." The names have just been released.Gen. Petraeus was questioned about the message of the op-ed in testimony before a Senate committee yesterday. The controversial Times column on Aug. 19 was called "The War As We Saw It," and expressed skepticism about American gains in Iraq. “To believe that Americans, with an occupying force that long ago outlived its reluctant welcome, can win over a recalcitrant local population and win this counterinsurgency is far-fetched,” the group wrote.

Military Orders - - To Obey or Not to Obey?

Probably the most famous case of the "I was only following orders" defense was the court-martial (and conviction for premeditated murder) of First Lieutenant William Calley for his part in the My Lai Massacre on March 16, 1968. The military court rejected Calley's argument of obeying the order of his superiors. On March 29, 1971, Calley was sentenced to life in prison. However, the public outcry in the United States following this very publicized and controversial trial was such that President Nixon granted him clemency. Calley wound up spending 3 1/2 years under house arrest at Fort Benning Georgia, where a federal judge ultimately ordered his release.

In 2004, the military began court-martials of several military members deployed to Iraq for mistreating prisoners and detainees. Several members claimed that they were only following the orders of military intelligence officials. Unfortunately (for them), that defense won't fly. The mistreatment of prisoners is a crime under both international law, and the Uniform Code of Military Justice (see Article 93 — Cruelty and Maltreatment).

 
"Any person subject to this chapter who is guilty of cruelty toward, or oppression or maltreatment of, any person subject to his orders shall be punished as a court-martial may direct."
 

It's clear, under military law, that military members can be held accountable for crimes committed under the guise of "obeying orders," and there is no requirement to obey orders which are unlawful. However, here's the rub: A military member disobeys such orders at his/her own peril. Ultimately, it's not whether or not the military member thinks the order is illegal or unlawful, it's whether military superiors (and courts) think the order was illegal or unlawful.

 

What RUB?

Each person IS responsible (if not held accountable) for each of their actions BECAUSE they alone have the power to do or not do what they do or not do UNLESS they are being forced to commit crimes or else.

The RUB is "OR ELSE".

Words are just words. When time and circumstance places a human being into a situation (of which the human being did not have the foresight to avoid) whereupon the rock and the hard place remain to be the ONLY choice left to that person at that time, then, at that time the person has TWO choices.

What happens if the person only has ONE choice?

Liberty.

Durkin died last Friday of a single gun-shot wound, but the Army has not said whether a weapon was found near her body. The Defense Department says it is investigating the incident, according to reports.
