“I think that there’s a lot that remains to look at, and I appreciate that President Obama doesn’t want to make it his purpose as a new president, with America in real distress in many directions, to go back and look at all this, but I think we in Congress have an independent responsibility, and I fully intend to discharge that responsibility,” Whitehouse said.

The subpoena, approved by an earlier vote of the House, was issued pursuant to "authority granted in H.R. 5 (111th Congress), and calls for Mr. Rove to appear at deposition on Monday, February 2, 2009."

Monday, the United Nations Special Rapporteur on Torture Manfred Nowak told CNN's Rick Sanchez that the US has an "obligation" to investigate whether Bush administration officials ordered torture, adding that he believes that there is already enough evidence to prosecute former Secretary of Defense Donald Rumsfeld.

"We have clear evidence," he said. "In our report that we sent to the United Nations, we made it clear that former Defense Secretary Donald Rumsfeld clearly authorized torture methods and he was told at that time by Alberto Mora, the legal council of the Navy, 'Mr. Secretary, what you are actual ordering here amounts to torture.' So, there we have the clear evidence that Mr. Rumsfeld knew what he was doing but, nevertheless, he ordered torture."

http://www.allannairn.com/2009/01/torture-ban-that-doesnt-ban-torture.html

When President Obama declared flatly this week that "the United States will not torture" many people wrongly believed that he'd shut the practice down, when in fact he'd merely repositioned it.

Obama's Executive Order bans some -- not all -- US officials from torturing but it does not ban any of them, himself included, from sponsoring torture overseas.

PRELIMINARY MEMORANDUM OF THE JUSTICE ROBERT H. JACKSON CONFERENCE ON FEDERAL PROSECUTIONS OF WAR CRIMINALS

quote:

I. INTRODUCTION.

An extensive complaint seeking federal prosecution of American officials who ordered, authorized, approved or committed war crimes is currently being prepared. While the complaint is in preparation, the Steering Committee of the Justice Robert H. Jackson Conference is issuing this preliminary memorandum setting forth several of the points to be presented more extensively in the complaint itself. Such points include the acts of torture and abuse which constitute war crimes, the high level individuals of the American Government who ordered, authorized, or approved these acts plus some of the lower level officials who committed them, and the warnings of illegality and immorality given to the culpable American officials -- as news of their secret actions slowly began to percolate within the Executive branch -- by persons ranging from FBI officials on the ground, to other executive investigative personnel on the ground, to military Judge Advocates General, to general counsels of the armed services. These warnings of illegality and immorality given by knowledgeable and experienced persons were ignored by the small group of high Executive officers who were determined that America would torture and abuse its prisoners and who had the decisionmaking power to secretly require this to be done.

We note that the information in this preliminary memorandum on criminal acts, officials who authorized them or carried them out, and warnings of criminality and illegality which were ignored, has become available in the last four years in a host of investigatory books, investigatory articles, initially secret government memoranda which have now been publicly released, internal governmental investigations, statements of present and former governmental officials and generals (e.g., Dick Cheney and Antonio Taguba), investigatory television programs, legal complaints and other legal documents, transcripts of interviews, congressional hearings and congressional reports (such as the recent report of the Senate Armed services’ Committees).

Among the books which extensively detail the matters written of here are Jane Mayer’s The Dark Side, Philippe Sands’ The Torture Team, Jack Goldsmith’s The Terror Presidency (Goldsmith is a former head of the Office of Legal Counsel), and Steven Wax’s Kafka Comes To America.

II. ACTS OF TORTURE AND ABUSE, AND THE LAWS THEY VIOLATED.

Thanks to the public's outcry, the torturers-in-chief could soon face prosecution. Click this link to help our movement grow and popularize the demand for the indictment of Bush.Dear Joseph,

The government's effort to stop prosecution has backfired. In the last few days the demands from people around the country and the world for the investigation and prosecution of Bush Administration torture officials has caused a dramatic shift in the U.S. political scene. IndictBushNow has mounted a major campaign flooding Congressional representatives with demands for justice and a constituent letter writing campaign to newspapers around the country.

Please click here to make a donation to help us keep up the momentum and support these efforts at this most important moment.

Under growing pressure from the people, President Obama has made a significant departure from the his position of last week that, "nothing will be gained by spending our time and energy laying blame for the past." Just today he stated that the prosecution of those who authorized the sadistic torture tactics "is going to be more of a decision for the attorney general within the parameters of various laws and I don't want to prejudge that."

Events are starting to break quickly:

The New York Times on Sunday issued a major editorial, "The Torturers' Manifesto," that began, "To read the four newly released memos on prisoner interrogation written by George W. Bush’s Justice Department is to take a journey into depravity." The editorial continued:

"Until Americans and their leaders fully understand the rules the Bush administration concocted to justify such abuses and who set the rules and who approved them there is no hope of fixing a profoundly broken system of justice and ensuring that that these acts are never repeated....

"And if the administration will not conduct a thorough investigation of these issues, then Congress has a constitutional duty to hold the executive branch accountable. If that means putting Donald Rumsfeld and Alberto Gonzales on the stand, even Dick Cheney, we are sure Americans can handle it. "

This view is being echoed by both major newspapers and local publications all over the country. There is no stepping back now.

Today's front page of the New York Times has this headline: "Pressure Mounts on President Obama for a More Thorough Investigation." The article goes on to say that the release of the torture memos has "provoked a furor that continued to grow on Monday as critics on various fronts assailed his position."

Congressional officials have called for accountability. Diane Feinstein, chair of Senate Intelligence Committee has issued a letter to the Obama Administration requesting that it withhold decisions on prosecution until the Committee is able to conduct a thorough investigation.

Feeling the heat, Dick Cheney has taken a gamble and gone on television to state that more memos should be released. As New York Magazine wrote this morning, "The more the American public learns and thinks about all of this, the more it's going to ask for someone's head ..."

We have extraordinary momentum on our side right now and we must seize the moment to make indictment and prosecution a reality. We must use all available means including newspaper ads, organizing constituent pressure on Congress, and intensive media and outreach work. Please take action right now to support the efforts of IndictBushNow by clicking here to make a critically needed donation. We need your help.

Action steps:

1. Write Congress
2. Forward this Email
3. Get three friends to sign the indictment referendum by going to IndictBushNow.org
4. Write Your Newspaper
5. Contribute to this Campaign

If you are a poor, hapless Afghan civilian whose family's bodies were ripped apart by U.S. bombs, does it really make a difference to you if the air "strikes" were ordered by the Moron from Texas, George W Bush, or the Agent of Change, Barack Obama?

An Invitation to Join the Peace Movement

To: True Majority, Moveon.org, Open Left, David Sirota, TPM, Campaign for America's Future, the Center for American Progress, and Daily Kos

The following groups and individuals are working very hard to block a war supplemental bill in Congress that would fund the continued war and occupation of Iraq and an escalated war and occupation in Afghanistan: After Downing Street, American Friends Service Committee, Nick Baumann, Brave New Films, Jennifer Brunner, Brendan Calling, Cindy Sheehan, Code Pink, Dday, Declaration of Peace, Democrats.com, Digby, Docudharma, FireDogLake, Bruce Gagnon, Glenn Greenwald, the Hip Hop Caucus, Howie Klein, Iraq Veterans Against the War, Just Foreign Policy, The Nation, Cynthia McKinney, Linda Milazzo, Michael Moore, Military Families Speak Out, Out of Iraq Blogger Caucus, Patriot Daily, Peace Action, Progressive Democrats of America, Jason Rosenbaum, Coleen Rowley, Jonathan Tasini, True Maine Blue, Doug Tudor, United for Peace and Justice, US Labor Against the War, Veterans for Peace, Voters for Peace, Joan Wile, Marcy Winograd, World Can't Wait, and the Young Turks.

We could use your help.

We've elected majorities to Congress to get us out of Iraq in 2006 and 2008. But we've allowed Congress to toy with us. 51 Democrats voted against the current war supplemental when they were sure it would pass. Two years ago 89 House Democrats signed a statement committing to voting against any war funding except for a withdrawal. This year 85 have signed onto a bill requiring an exit strategy for Afghanistan. And 73 belong to something called the Out of Iraq Caucus. And yet we are being told that the way to "clear the decks" and "move on" to healthcare and energy is to further fund the wars that elected Democrats claim to oppose and that we all claim to oppose.

What are our chances of success? They are much better in the long term if we push hard in the short term. If we can strip unrelated measures out of war bills, if we can force war bills to be passed primarily by Republicans, if we can create an anti-war caucus with negotiating power, if we can change the discourse to include the peace movement we will be closer to achieving peace. Every day that we delay the current bill is a victory. Will you help us? Will you send an Email to your list and post a blog on your site asking your members to phone Congress and ask for No votes on the war supplemental? Will you be part of a growing peace movement now, when we might succeed, just as you were when we had no chance?

We need you.

In Solidarity,
David Swanson

What happens when the official truth is false?

By the way, everything I'm sharing with you tonight is in the public record.

What is the official truth, other than your own belief, and what do you feed that belief on a daily basis?

Now ask why?

Goal:
Explain, by discussion, the true divide between good and bad politicians.

Method:
One person offers a viewpoint to be read by other people with the goal in mind and then other people intend to rephrase the initial viewpoint so as to improve upon it in the effort to reach the goal i.e. discussion.

Pre-judgment effort:
In order to understand the true difference between a good and a bad politician the viewer may need a few background checks so as to ensure a more accurate foundation from which to launch the effort to arrive at the goal.

Does the viewer view politicians as people or does the viewer view politicians as beings that are not exactly people?

Are politicians held as, or even more, accountable for crimes (such as torture, mass murder, and actions that threaten the survivability of the species), as accountable, as any other person including people who are not politicians?

If the viewer intending to aid in arriving at the desired goal is operating under the impression that politicians are not people, then the viewer may have a hard time helping anyone arrive at the goal of this discussion.

If the viewer views politicians as exceptional beings that are not to be held accountable for things like torture, mass murder, and actions that threaten the survivability of the species (such as provoking nuclear war), then the viewer may be working from a foundation that is similar to quick sand; where the house being built will sink quickly.

Is it good or bad to be controlled by people who have no moral conscience?

If the answer is yes, yes it is good to be controlled by people who have no moral conscience, today, then is it possible that tomorrow may not be so good?

Historical context:
Once upon a time a group of people managed to avoid being controlled by people who have no moral conscience and that group of people prospered because less time and energy was spent on conflict and more time was spent on other things, fun things, happy things, interesting things, productive things, and prosperous things.

A morally bankrupt person controlling a morally bankrupt group of people then took their process of infighting, back stabbing, killing or being killed to the other group of people for their version of fun, enslavement, rape, robbery, torture, mass murder, and other things.

Careful study of history records these simple and easy to understand conflicts between moral individuals, morally based associations of moral individuals, and the opposition group made up of immoral (not just amoral) individuals associated by their preferred immoral foundations.
  1. Voluntary associations (moral people freely associating with each other in liberty)
  2. Involuntary associations (immoral people enforcing association i.e. master/slave)

Proof of the facts:
Along the way, in human history, where moral people were forced into conflict with immoral people the moral people invented something called “The Scientific Method” as a means by which the foundations of life can be made less shifty, less fluid, less ambiguous, less unknown, less dark, less horrid, less dangerous, less threatening, less mysterious, less torturous, less murderous, and this method aided the moral people in the effort to survive well, to prosper, and to ensure a happy life for posterity.

The simple idea behind “The Scientific Method” is easier to see from a moral perspective as the moral perspective intends to defend against the immoral perspective since immoral people are prone to be violent, to steal, to rape, to torture, and to murder anyone, including moral, amoral, and immoral people; and then they cover their crimes with lies. The easy part to see is the part where moral people intend to accurately discriminate between liars and people who don’t lie on purpose, for any reason. There must be some way, the developing scientific mind asks, to accurately discriminate between fact and fiction, no different than knowing not to stare at the sun is factually known by mankind, with few exceptions. Accurately find the liars and the work load of finding, and avoiding, the immoral people is roughly cut in half.

One scientific mind uses the scientific method to find another scientific mind so as to collaborate and share the work load of finding more proof of more facts, like retina burn is the result of looking into the sun, skin burn is the result of sticking your hand in the fire, and the end of our species is the result of believing in lies being propagated by legal criminals, or immoral politicians who torture, mass murder, and lie to cover their past, present, and future crimes.

Initial viewpoint (to begin the discussion on the topic):
A good politician is someone who has managed to become a leading power, a controlling power, of a voluntary association that has formed as a power to defend against false and violent criminal powers, including false and violent political powers.

A bad politician is someone who has managed to become a leading power, a controlling power, of an involuntary association that has formed as a power to injure innocent victims for fun and profit.

Moral people move away from bad politicians like clean people move away from filth, moral people don’t go toward the filth on purpose – unless the purpose is to clean up the filth and avoid infections caused by filth.

Immoral people move toward bad politicians like babies move towards their mother’s nipples, there they find nourishment.

Amoral people are the wild cards.

Restatement of purpose:
Explain, by discussion, the true divide between good and bad politicians.

Bad politicians, as a rule, lie to cover their true intent which is to injure innocent people for fun and profit.

Good politicians are scarce, hard to find, among all the liars, when lies are commonly believed to be true.

The true divide between good and bad politicians is the same divide as the divide between fact and fiction, prosperity for posterity and a torturous and murderous extinction of the human species, moral and immoral conduct, right and wrong, good and bad.

Any confusion concerning the accurate identification of precise demarcation between good and bad politicians is as beneficial to the bad politicians as confusion is destructive to liberty.

So why would anyone ever start such a discussion anywhere, and why would anyone else ever participate is such a discussion. What would be the point?

Here is another sound bite of sorts:

http://www.lewrockwell.com/roberts/roberts269.html

I find this:

++++++++++

Consider the propagandistic term, "gun violence," popularized by gun control advocates. This is a form of reification by which inanimate objects are imbued with the ability to act and to commit violence. Guns, of course, cannot be violent in themselves. Violence comes from people who use guns and a variety of other weapons, including fists, to commit violence.

++++++++++

How is that any different than blaming this or that on "the government" or "the state"?

I see no difference; the end result is an impetus to kill them all – indiscriminately.

Collective punishment is invented by collectivists?

Is that too ambiguous?

A CALL TO ACTION – FORWARD WIDELY

http://www.NYCCAN.org

July 27, 2009

9/11 FAMILIES, FIRST RESPONDERS AND SURVIVORS TO TAKE NEW YORK CITY TO COURT OVER NYC CAN PETITION

SEVENTY THOUSAND New Yorkers signed the NYC CAN petition, raising their voices in support of NYC CAN’s demand for accountability. They have chosen to place the decision to create a new 9/11 investigation – a REAL 9/11 investigation – exactly where it belongs: before the voters of New York City this November. The voices of SEVENTY THOUSAND Americans who believe in democracy and believe that government exists to serve the people – and not the other way around – have been GAGGED by ONE so-called “PUBLIC SERVANT” – The New York City Clerk – who denied the petition and the voice of the people.

Welcome to America. Democracy denied.

Did you REALLY expect those in halls of power to honor the WILL OF THE PEOPLE? Did you expect this demand for accountability to go uncontested by those who have forgotten the very meaning of the word? Perhaps this obstruction of democracy would go unchallenged in THEIR America. Not in OUR America.

9/11 family members, first responders and survivors expected nothing less than business as usual and ARE NOT HAVING IT. They are preparing to take the City of New York to court to challenge the wrongful denial of our right to decide on the creation of a new 9/11 investigation.

Friends, your determination and generosity have brought us to this crucial moment. TRUTH IS AT THE CROSSROADS, DEMOCRACY UNDER FIRE AND THE DEFINING MOMENT IN THE QUEST FOR ACCOUNTABILITY IS UPON US. This is YOUR movement and nothing may bring you closer to attaining truth than NYC CAN. Stand in the light and demand ANSWERS, not in the shadows of those who would deny you such answers.

THE BIG NEWS: the most experienced election lawyer in New York City stands ready to represent the 9/11 families, first responders and survivors in court in an HISTORIC FIGHT FOR DEMOCRACY AND TRUTH. BUT WE DESPERATELY NEED YOUR FINANCIAL SUPPORT TO MAKE IT HAPPEN. This is your chance – your ONE chance – to stand with the 9/11 families, first responders and survivors, and demand accountability. THIS IS WHAT WE HAVE WORKED FOR, AND WHAT WE CAN ACHIEVE IF WE STAND TOGETHER NOW.

Donate over $25 and we’ll mail you a free NYC CAN button. Donate over $50 and you will receive a free NYC CAN button and a well-made NYC CAN t-shirt.

ACT RIGHT NOW. Go to – http://nyccan.org/donate.php – and donate whatever you can to bring the quest for answers to the biggest stage it has ever had: THE NEW YORK CITY BALLOT
