Few in the House of Representatives have any intention of doing anything with the last 35 articles of impeachment Kucinich set before them last month, so the former presidential candidate appears to be lightening the load. Kucinich sent a letter to colleagues Tuesday asking them to support a single article of impeachment, to be introduced Thursday, which accuses President Bush of leading the country to war based on lies.

 

A simple majority in The House of Representatives (representing whom?) will cause a legal impeachment.

That is a simple majority that does IMPEACH - end of story.

Then the IMPEACHED are tried in the Senate.

The House Judiciary Committee will hold a hearing on one of Ohio Congressman Dennis Kucinich's 35 articles of impeachment against President Bush. But House Speaker Nancy Pelosi and other Democratic leaders in the chamber have signaled that they do not want the committee -- let alone the full House -- to take a vote on impeachment.

We really ought to be inspired by the 4 courageous Iowans who dared to try to hold Rove accountable for his crimes. Government officials, no matter how high-ranking, should be prevented from even walking the street without fear of arrest, if they are guilty of a crime.

Now, it appears the House cannot start impeachment proceedings unless a president and his party would agree to turn over incriminating evidence. Of course, the use of a president’s authority to conceal or destroy evidence in such an investigation is itself a potentially impeachable offense. Pelosi prevented a John Dean from coming forward by barring the hearing. In past hearings, we have seen former Bush officials implicate the Administration in investigations such a the firing of the US Attorneys. Indeed, if this is Pelosi’s rationale for barring impeachment, why is the House pursuing contempt on these other investigations? It appears that a lack of cooperation does not end matters that the House wants to address.

The biggest problem, however, is that the crimes are hiding in plain view. A federal court has already found the domestic surveillance program was unlawful and there is no question as to the torture question — as found by the International Red Cross when it informed Bush that war crimes charges could be brought.

HOUSTON (Reuters) - A grand jury in South Texas indicted U.S. Vice President Dick Cheney and former attorney General Alberto Gonzales on Tuesday for "organized criminal activity" related to alleged abuse of inmates in private prisons.

The indictment has not been seen by a judge, who could dismiss it.

The grand jury in Willacy County, in the Rio Grande Valley near the U.S.-Mexico border, said Cheney is "profiteering from depriving human beings of their liberty," according to a copy of the indictment obtained by Reuters.

The indictment cites a "money trail" of Cheney's ownership in prison-related enterprises including the Vanguard Group, which owns an interest in private prisons in south Texas.

Former attorney general Gonzales used his position to "stop the investigations as to the wrong doings" into assaults in county prisons, the indictment said.

Moderation in the pursuit of justice is no virtue, and its no way to begin an administration that was elected on promises of change. What it says is that if you're one of the elite and powerful, your violations of the law will be overlooked, no matter how much damage you did to our country’s standing in the world.

What signal does it send to Mr. Bush's gang of unindicted co-conspirators, who've unwrapped a Pandora’s boxful of other offenses — from perverting the administration of justice, to illegally eavesdropping on the phone conversations and e-mails of ordinary Americans, to salting the stream of intelligence with bogus material, to inviting their cronies to loot the Treasury with no-bid military contracts, to lying under oath to congressional oversight committees, to applying political litmus tests to the hiring of civil service employees to the wholesale destruction of White House e-mails and records? Etcetera. Etcetera.

This nation was founded on the principle of equal justice under the law. No one — no one — ought to be able to skate or hold a get-out-of-jail-free card by virtue of having been the most powerful felon in the land, or of working for him.

This signal on torture investigations says that Sen. Obama wants to start his administration as a uniter, not a divider, trying to untangle the unholy mess that the Decider and Co. are leaving behind them in the economy, in our military, in virtually every walk of our national life. It speaks to his desire to reach across the aisle to the defeated Republicans and try to bring them back into the fold as Americans.

That's all well and good, but not if it comes at the cost of lifting the blindfold off Justice’s eyes and letting her pick and choose who'll pay for criminal acts and who won't. That's no way to begin, and no way to continue.

  It requires no crystal ball to see that we are embedded in a system that has no qualms about harassing old men in wheelchairs or making pregnant women walk through x-ray machines. It is the same system that is killing scores of Iraqi and Afghan civilians daily, and killing the planet systemically. It is a system that requires us to be sleepwalkers, rather than alert and sensitive humans.
