What’s the first thing the cop says when he walks up to your window?
“License and registration please”.
When you comply, you are giving him jurisdiction over you, and you are waiving your rights, and it gives him the assumption that he has control and jurisdiction over you.
Instead of instantly complying, you say “Officer, I pulled to the side of the road because I saw your emergency lights go on. What is the emergency?”
“I pulled you over because you were speeding.”
“Do you consider that an emergency?”
“No, but you were speeding, and I am going to cite you for driving too fast.”
(We haven’t researched this yet, but it could be something worth pursuing...)
“So, I need to see your driver’s license and registra-tion.”
“You are an officer of the law, right? Deemed to know the laws that you are enforcing, right?” Great!
So you know that I am legally entitled to verify your identity and authority under USC Title 5, §552a(e)(3), and that if you refuse to answer these questions we cannot conduct business here, under-stand?
At this point you pull out your clipboard and start asking the questions. He will not be a happy camper...In fact he will probably just tell you to slow down and be careful. By law he MUST answer all 24 questions and sign at the bottom. This rarely happens.
